1. General provisions

1.1. The e-commerce website of Cruysberghs Chemical bv, a bvba with registered office at Heppensesteenweg 56, 3945 Ham, VAT BE 0863.278.026, RPR Hasselt (hereafter 'Cruysberghs Chemical bv') offers its customers the opportunity to purchase the products from their webshop online.

1.2. The present general conditions webshop apply to every order placed by a visitor of this e-commerce website ("customer"). When placing an order through the webshop of Cruysberghs Chemical bv, the customer must explicitly accept these conditions, with which he agrees to the applicability of these conditions, to the exclusion of all other conditions.

1.3. Additional terms and conditions of the customer are excluded, except if they have been accepted in advance by Cruysberghs Chemical bv in writing and explicitly.

2. Price
2.1. All quoted prices are expressed in EURO, always including VAT unless otherwise stated and all other fees or taxes that are required by the customer.
2.2. Delivery costs are listed separately.
2.3. The indication of price only refers to the articles as described verbatim. The accompanying photos are designed for decoration and may contain elements that are not included in the price.

3. Offer
3.1. Despite the fact that the e-commerce website is compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Apparent mistakes or errors in the offer are not binding on Cruysberghs Chemical bv. Cruysberghs Chemical bv is only bound to an obligation of means for the correctness and completeness of the information provided. Cruysberghs Chemical bv is in no way liable in the event of manifest material errors, typesetting or printing errors.
3.2. If the customer has specific questions about e.g. sizes, availability, delivery time or delivery method, we request the customer to contact our customer service in advance.
3.3. The offer is valid as long as stocks last and can be adjusted or withdrawn at any time by Cruysberghs Chemical bv. Cruysberghs Chemical bv cannot be held responsible for the unavailability or being sold out of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

4. Online purchases
4.1. The customer has the opportunity to purchase the articles from the assortment of Cruysberghs Chemical bv online.
4.2. To purchase a product, the customer adds the product to your shopping basket. Afterwards, the customer enters his contact details and invoicing data. Subsequently, the customer receives an overview of your order and payment methods.
4.3 The customer has the choice between the following payment methods:

4.4. Cruysberghs Chemical bv is entitled to refuse an order due to a serious shortcoming of the customer with regard to orders in which the customer is involved.
4.5. The day of receipt of the payment the products will be sent, if in stock. The products are only sent on receipt of the full payment.
4.6. If we have not received payment 30 days after the order, the order will be canceled.
4.7. Orders are invoiced at pickup / shipping. In the event of non-collection or late collection, an invoice will be issued after a period of 15 working days.

5. Delivery
5.1. The order is sent on receipt of payment. The delivery time is 3 to 5 working days after receipt of payment, under normal circumstances, except for public holidays, strikes and the like. The delivery costs are stated with the order.
5.2. Items ordered through this webshop are delivered all over Europe. If the customer wants to order from another country, the customer must contact the customer service.
5.3. Delivery is done by mail. With the exception of large numbers, these are sent by courier.
5.4. The order is sent to the delivery address chosen by the customer.
5.5. Any visible damage and / or qualitative deficiency of an article or other defect in the delivery must be reported to Cruysberghs Chemical bv without delay.
5.6. The risk of loss or damage passes to the customer from the moment he (or a third party designated by him, who is not the carrier) has received the goods physically.
5.7. All items that are ordered can be picked up at our office after receiving a message.

6. Reservation of ownership
6.1. The delivered items remain the exclusive property of Cruysberghs Chemical bv up to the moment of full payment by the customer.
6.2. The customer undertakes, if necessary, to inform third parties of the retention of title of Cruysberghs Chemical bv, for example to anyone who seizes the not yet paid items.

7. Warranty
7.1. Pursuant to the law of 21 September 2004 concerning the protection of consumers in the sale of consumer goods, the consumer has statutory rights. This legal guarantee applies from the date of delivery to the first owner. Every commercial guarantee leaves these rights unabated.
7.2. To make an appeal to the guarantee, the customer must be able to present a proof of purchase.
7.3. For articles that were purchased online and delivered to the customer's home, the customer must contact the Cruysberghs Chemical bv customer service and return the item to Cruysberghs Chemical bv at his expense.
7.4. In determining a defect, the customer must inform Cruysberghs Chemical bv as soon as possible. In any case, any defect must be reported by the customer within a period of 14 days after receipt. Afterwards, no right to repair or replacement lapses.
7.5. The (commercial and / or legal) guarantee never applies to defects that arise as a result of accidents, neglect, falls, use of the article in violation of the purpose for which it was designed, non-compliance with the instructions for use or user manual, modifications or changes to the article, crackdown, poor maintenance, or any other abnormal or incorrect use.
7.6. Defects that manifest themselves after a period of 1 month following the date of purchase, if applicable delivery, shall be deemed to be no hidden defects, unless proven otherwise by the customer.

9. Penalties for non-payment
9.1. Without prejudice to the exercise of other rights owned by Cruysberghs Chemical bv, in the event of non-payment or late payment from the date of default, the customer shall owe an interest of 10% per annum on the unpaid amount by operation of law and without notice. In addition, the customer is legally and without notice a flat-rate compensation of 10% on the amount involved, with a minimum of 25 euros per invoice.
9.2. Notwithstanding the foregoing, Cruysberghs Chemical bv reserves the right to take back the (fully) paid items.

14. Applicable law - disputes

14.1. Belgian law applies, with the exception of the provisions of private international law on applicable law.
